Breast augmentations are one of the most popular cosmetic procedures in the UK. While many women undergo the procedure with the aim of boosting their confidence, some have their confidence knocked by a botched procedure.
So if you have a breast augmentation that doesn’t meet your expectations what can you do? And in what circumstances are you entitled to bring a breast augmentation claim?
One option is to pursue a claim for a poor aesthetic outcome or the fact that the incorrect surgery has been performed which did not comply with the instructions you gave to your cosmetic surgeon. For example, our cosmetic surgery negligence team have recently settled cases for women who have needed to undergo revision surgery due to their initial surgery being performed with use of the incorrect implants.
Women should be provided with sufficient information to allow them to make an informed decision regarding their surgery, but this does not always happen. For instance, some women are not advised of the risks associated with their chosen surgery, including those which materialise after their surgery. If you can show that if you had been forewarned of the risks of the surgery, then you would have chosen alternative treatment to obtain your desired outcome, then you may also be able to make a compensation claim.
Fat transfer is also being used during breast augmentation surgery, with the aim to create more natural looking breasts. However, many women are not being warned in advance of the risks of fat resorption, which can result in the appearance of asymmetrical breasts after their surgery. As a result of this, they are often required to undergo revision surgery to obtain a satisfactory symmetrical appearance.
Whether you have not been forewarned of all material risks associated with breast augmentation, your surgery has been performed incorrectly, has failed to comply with your instructions, or has resulted in a poor aesthetic outcome, you may be able to pursue a clinical negligence claim.
If you feel you have been let down by a cosmetic surgeon and wish to make a breast augmentation claim, do not delay in seeking specialist legal advice. You must bring a clinical negligence claim within three years of the date of the error, or three years from the date of knowledge of that error, so it is important to act quickly.
