Case study of a successful dermal filler compensation claim.

We have recently represented a woman who was left suffering from the effects of an occlusion, caused by dermal filler blocking a facial artery.

She attended what she believed to be a reputable clinic to undergo dermal filler to her nasolabial folds. Within hours of this treatment, she began to experience significant pain and mottling to the treated area. She reached out to the cosmetic clinician for advice. They visited her at home and administered hyaluronidase in an attempt to break down the filler. Two attempts to aspirate the blockage were made, but the pain and mottling continued.

Despite asking the clinician if she should attend her local accident and emergency department, our client was advised not to. Thankfully, she disregarded this advice, and after visiting A&E she received an immediate referral to a specialist.

It was ultimately determined that the cosmetic clinician had accidentally injected the filler into a vein.

While under the care of the specialist, our client began to develop pustules, which is an early stage of necrosis, and went on to experience a nose collapse. She was advised following the successful removal of the blockage, that she had been very fortunate to have been treated in time, as she had narrowly avoided permanent damage to her vision.

Upon hearing the traumatic ordeal that our client had endured, Carly Sylvester – a lawyer specialising in beauty treatment claims and winner of Young Achiever of the Year at the Personal Injury Law Awards 2023 – knew she could assist her in obtaining compensation.

A claim was submitted to the clinic on the basis that the cosmetic treatment had been negligently administered. Legal liability was initially denied by the clinic. However, Carly was able to use her negotiating skills to highlight the strengths of her client’s case and achieve a very favourable out-of-court settlement.
