What is dermal lip filler?
Dermal lip fillers are used to increase the volume and definition of the lips. The lip filler itself is made of Hyaluronic Acid, which is naturally found within the human body.
What is the lip filler procedure?
A numbing cream is placed on the lips to ensure they are numb and relaxed before the filler is injected directly into the lips. This procedure is usually quick to administer and is more or less pain free.
What can go wrong with a dermal lip filler?
Lip fillers are an aesthetic procedure, therefore there will always be some risks involved. According to a study conducted by the British Association of Aesthetic Plastic Surgeons (BAAPS) 69% of surgeons have examined a patient who has experienced problems arising from lip fillers. Where patients had issues arising from a permanent filler, an alarming 84% required a corrective surgical procedure or were assessed as being beyond surgical help.
Among the problems commonly encountered with dermal lip fillers are:
- Lumps in the lips or asymmetric lips;
- Leaking implants;
- Allergic reaction causing swelling, redness or itching;
- Severe and prolonged swelling or bruising of the lips;
- Infection in the lips;
- Tissue loss following injection into a blood vessel; and
- Scarring.
Can I make a dermal lip filler claim if my procedure goes wrong?
In order to make a dermal lip filler compensation claim we will need to prove that there has been a mistake made in administering the procedure.
The beauty therapist or practitioner who administered the lip filler may have failed to inform you of the side effects or risks associated with the procedure, preventing you from making a rational decision on whether you wish to proceed. If they have failed to do this, they you may have a claim for compensation.
Alternatively, the dermal lip filler may have been administered incorrectly. This can occur, for instance, when too much filler is injected into the lips. Problems can also arise when fillers are positioned incorrectly, causing lumps, bruising and severe swelling.
What should I do if my dermal lip filler goes wrong?
In order to make a dermal lip filler compensation claim it is important that we have all the information and necessary evidence to support the case. This may include the following:
- proof that the beautician or practitioner has insurance in place to carry out dermal lip fillers;
- photographs of the cosmetic appearance of the treatment;
- your medical or hospital records;
- details of the practitioner, clinic, spa or salon responsible for your treatment;
- the receipt for the treatment you received; and
- any correspondence you have had with the practitioner, clinic, spa or salon, including any report made by you.
Can I still make a dermal lip filler claim if I signed a disclaimer?
You may be able to make a claim even if you have signed a legal disclaimer. Signing a disclaimer does not mean the practitioner or the clinic, spa or salon is immune from having a compensation claim made against them. They have a legal duty to ensure you are not harmed and that duty applies even if a disclaimer was signed.
What could prevent me from claiming dermal lip filler compensation?
There are strict time limits on bringing a compensation claim for personal injury. You must settle your claim or issue court proceedings prior to the third anniversary of the incident giving rise to your injuries; or the date you became aware of them.
